REACH DIRECTIVE
Application of regulation n° 1907/2006 (REACH directive)
Dear Client,
On the 1st. of June 2007 there entered into force over the whole Eu-
ropean Union the new regulatory system (REACH - REGULATION (EC) N.
1907/2006), for the evaluation, registration and control of the release of
substances and chemicals on to the European market. This requires that
all substances and chemicals produced in or imported into the European
Union, in quantities superior to 1 ton/year must be registered with the
European Chemicals Agency (ECHA). In order to make use of a transition
period during which it will be possible to prepare the registration dossier,
it will be necessary to perform a preliminary registration before 01/12/08.
It should be remembered that, if before this date the pre-registration has
not been performed, the substance in question will not be able to be rele-
ased on to the market until registration has been carried out.
In this regard it is communicated that Novellini S.p.A. holds only the role
of downstream user, neither producing nor importing substances inside
the EU, and therefore does not have to carry out the duties relative to the
registration of such substances.
In order to guarantee you the regular continuity of supply of our products,
with this document we inform you that we are assuring ourselves that
WARRANTY TERMS
ORDERS
The orders are binding for the customer, while they will have the value of a simple
proposal for Novellini. Orders become final only after explicit acceptance.
CANCELLATION OF ORDERS
No order cancellation will be accepted without the prior and explicit authorisa-
tion of Novellini, which reserves the right to charge any consequent costs and
charges, depending on progress in production.
SPECIAL ORDERS
Orders for special products must always be received in writing and must be ac-
companied by an advance payment of at least 25% of the total amount. No re-
turns or cancellations of any kind will be accepted on such orders.
DELIVERY TIMES
Delivery times are purely indicative and shall in no case constitute grounds for
total or partial cancellation of the order, nor for any claim for compensation of
any kind. If the delivery time is essential for the purchaser, it must be specifically
indicated in writing when the order is placed.
PRICES AND PAYMENTS
The sales prices correspond to those shown in the official price list on the date
the order is placed. Novellini reserves the right to change these prices in the
event of sudden increases in production costs and raw materials, even without
prior notice. Existing orders with a delivery schedule beyond 60 days from the
date of entry into force of the new price lists will be subject to the new price
system.
The terms of payment shall be those agreed specifically for each customer. In
the case of new customers, or changes in the conditions themselves, these
conditions must be expressly stated at the time of the order and subsequently
approved by Novellini.
In case of delayed payment, interest will be charged according to law.
All sales made will be subject to retention of title, remaining the exclusive prop-
erty of Novellini until full payment of the same.
our suppliers, if necessary, perform the pre-registration. Should that not
happen we will replace the substances in use with others complying with
the requisites of the binding regulations. However our supply will undergo
no modification downstream of the REACH obligations.
As regards our products it appears that they all come under the definition
of article present in the Regulation (EC) N. 1907/2006 of the European
Parliament and Council of 18th. December 2006. In particular within the
meaning of art. 7 “Registration and notification of the substances con-
tained in articles”, comma 1 letter b), such articles are not subject to
registration as any substances contained in them are not destined for
release in normal or reasonably foreseeable conditions of use.
Moreover, it is pointed out that, still within the meaning of Regulation
(EC) N. 1907/2006, the above mentioned articles, based on their cha-
racteristics, do not come under the obligations foreseen by art. 33 “Duty
to communicate information on substances present in articles” as the
percentage in weight of the substances held to be dangerous, within the
meaning of the present regulation, is lower than 0,1% of the total weight
of the article.
PACKAGING
The price agreed for Novellini products is inclusive of normal packaging. In case
of special transport needs and consequent packaging, a special price will be
agreed upon according to the additional cost incurred. The iron pallets used
for the transport of Novellini products are considered "returnable" as they are
the property of the seller. In the event of failure to return them, the company
reserves the right to charge the value. These iron pallets are designed for the
exclusive use of the vendor's products. The vendor relieves itself of all responsi-
bility for improper use of this property.
TRANSPORT
Please refer to art. 1510 of the Civil Code.
WARRANTY
The goods are covered by a warranty in accordance with the provisions of the
Italian Civil Code, special laws and European regulations on the subject. This
warranty is extended to 2 years from the date of delivery of the product and
will be taken into consideration only upon written complaint. No warranty shall
be acknowledged if, in the event of a recognisable conformity defect resulting
from the opening of the packaging, the product is nevertheless installed and is
reported only afterwards.
GOODS RETURNS
Any return of Novellini products must always be made after specific authorisa-
tion, to be requested on a case-by-case basis.
LEGAL DISPUTES
The above conditions are fully accepted by the customer at the time of placing
the order with Novellini. For any dispute in this regard, the only competent Court
is the Court of Mantua.
All products are insured for damage caused to the consumer in accordance with
EU directive EEC 85/374 of 1985, as amended.
Novellini S.P.A. declines all responsibility for installations not carried out properly,
not in accordance with provided instructions.
Novellini S.p.A. reserves the right to make partial or radical changes to the prod-
ucts as well as to remove them from the catalogue without prior notice. The fit-
tings and colour shades in the photographs are purely indicative.
This price list cancels and replaces previous lists. The pictures and information in this catalogue are for information only and may be
changed without prior notice.
